FDXM Marketing, LLC (“FadexMarketing,” “we,” “us,” or “our”) operates fadexmarketing.com (the “Site”). This Privacy Policy explains how we collect, use, share, and protect your Personally Identifiable Information (“PII”) when you visit the Site, buy our products, or subscribe to our emails.

PII is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. By using the Site, you agree to the practices described in this policy. Please read it carefully.

1. Information We Collect

Information you give us

When you place an order, create an account, subscribe to our newsletter, contact support, or otherwise enter information on the Site, we may ask for:

  • Your name and email address
  • Billing address and phone number
  • Payment details (entered directly with our payment processor; see Section 4)
  • Any message or information you send us

Information collected automatically

When you browse the Site, we and our service providers may automatically collect technical information such as your IP address, browser type, device type, pages viewed, referring URL, and the date and time of your visit. This is collected through cookies and similar technologies (see Section 5).

2. When We Collect Information

All payment transactions are processed through a third-party payment gateway. We do not store or process full credit card numbers on our servers.

No method of transmission over the internet or electronic storage is 100% secure, so we cannot guarantee absolute security.

5. Cookies and Similar Technologies

Cookies are small files that a website or its service provider places on your device through your web browser (if you allow it). They let the Site recognize your browser and remember certain information.

We do not currently include or offer third-party products or services on the Site. If we add links to third-party websites in the future, those sites will have their own privacy policies, and we are not responsible for their content or practices.

8. Google

Google’s advertising requirements are summarized in Google’s Advertising Principles, which are designed to provide a positive experience for users. We have not enabled Google AdSense on the Site, but we may do so in the future. If we do, we will update this policy.

9. Do Not Track Signals

We honor Do Not Track (DNT) signals. When a DNT browser mechanism is in place, we do not track, place advertising cookies, or serve behavioral advertising.

10. Third-Party Behavioral Tracking

We do not allow third parties to collect information about your online activities over time and across different websites when you use the Site.

11. Email Marketing (CAN-SPAM Act)

The CAN-SPAM Act sets the rules for commercial email, gives recipients the right to stop receiving emails, and sets penalties for violations. We collect your email address to:

  • Send information, respond to inquiries, and handle other requests or questions
  • Process orders and send information and updates about your orders
  • Send you additional information related to your product or service
  • Market to our mailing list and continue emailing customers after the original transaction

In line with CAN-SPAM, we agree to:

  • Not use false or misleading subject lines or email addresses
  • Identify messages as advertisements in a reasonable way
  • Include our physical business address in marketing emails
  • Monitor any third-party email marketing service we use for compliance
  • Honor opt-out and unsubscribe requests promptly
  • Let you unsubscribe using the link at the bottom of every email

Our marketing emails may contain tracking technology that records activity such as email opens, link clicks, forwards, and the time and date of that activity. We use this information to improve future emails and send you more relevant content.

To unsubscribe from future emails at any time, click the unsubscribe link at the bottom of any email, or email us at the address below, and we will promptly remove you from all marketing correspondence.

12. Data Retention

We keep your personal information only as long as needed to provide our products and services, maintain your account and download access, comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements.

13. Your Privacy Rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate information
  • Request deletion of your information
  • Receive a copy of your information in a portable format
  • Opt out of marketing communications
  • Object to or restrict certain processing

You can update much of your information by logging into your account. To make any other request, contact us using the details below. We will respond within the time required by applicable law and will not charge a fee or discriminate against you for exercising your rights. We may need to verify your identity before completing a request.

Nevada residents

Under Nevada law (NRS Chapter 603A), you may direct us not to sell certain covered information that we have collected or will collect about you. We do not sell covered information, but you may still submit a request by emailing us.

California residents

Under the California Online Privacy Protection Act (CalOPPA) and the California Consumer Privacy Act, as amended (where applicable), we agree that:

  • You can visit the Site anonymously.
  • A link to this Privacy Policy, containing the word “Privacy,” appears on our home page and can be easily found.
  • You will be notified of changes to this policy on this Privacy Policy page.
  • You can change your personal information by logging into your account or contacting us.
  • We do not sell or share your personal information for cross-context behavioral advertising.

UK and European visitors

If you are in the United Kingdom or European Economic Area, we process your personal data on the basis of performing our contract with you (for example, delivering your order), your consent (for example, marketing emails, which you can withdraw at any time), our legitimate interests (for example, improving and securing the Site), and compliance with legal obligations. You have the rights listed above under the UK GDPR and EU GDPR and may lodge a complaint with your local data protection authority. Your information is processed in the United States.

14. Children’s Privacy (COPPA)

The Children’s Online Privacy Protection Act (COPPA) gives parents control over the collection of personal information from children under 13. The Site is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has given us personal information, please contact us and we will delete it.

15. Data Breach Notification

In line with the Fair Information Practice Principles, if a data breach affecting your personal information occurs, we will notify you by email without unreasonable delay, and in any event as required by applicable law.

We also agree to the Individual Redress Principle, which means you have the right to legally pursue enforceable rights against data collectors and processors who fail to follow the law, including recourse to courts or government agencies to investigate and/or prosecute non-compliance.

16. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted means you accept the updated policy.
